Welcome to VocaPath ("VocaPath," "we," "our," or "us"). These Terms of Use and Privacy Notice (collectively, the "Agreement") govern your access to and use of the VocaPath platform, including our website, mobile application, vocational assessments, AI-generated recommendations, and all related services (collectively, the "Services").

By creating an account, logging in, or otherwise using our Services in any manner, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, you must not access or use the Services.

Your explicit consent is required at sign-up or login and is captured via a mandatory acknowledgment checkbox. Your continued use of the Services after any updates to this Agreement constitutes acceptance of the revised terms.

VocaPath provides an AI-powered vocational guidance platform designed to support users in understanding their aptitudes and exploring career and educational pathways. Our Services include:

• Vocational Assessments: Structured psychometric questionnaires that evaluate aptitude areas such as analytical reasoning, creativity, interpersonal skills, and more.

• AI-Driven Personalized Recommendations: Algorithmic analysis of your assessment responses to generate ranked career suggestions and aptitude profiles tailored to your individual results.

• Educational & Career Pathway Suggestions: Curated information about academic programs, universities, technical institutes, and professional pathways relevant to your top career matches.

• Downloadable Reports: PDF summaries of your results that you may share with counselors, educators, or family members.

Important Limitation: All results, recommendations, and analyses provided by VocaPath are for informational and exploratory purposes only. They do not constitute professional career counseling, psychological assessment, academic advising, or any form of guaranteed outcome. VocaPath does not guarantee that following any recommendation will result in admission to any institution, employment, or any particular career or financial outcome.

By using the Services, you agree to the following:

Accurate Information: You must provide truthful, accurate, and complete information when registering and completing assessments. Providing false or misleading information may result in inaccurate results and may violate these Terms.

Personal Decision-Making: You acknowledge that any decisions you make — including but not limited to academic enrollment, career choices, or financial commitments — based on VocaPath's recommendations are made entirely at your own discretion and risk. VocaPath does not bear responsibility for the outcomes of such decisions.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Prohibited Conduct: You agree not to misuse the platform, attempt to reverse-engineer the AI models, scrape data, impersonate others, or use the Services for any unlawful purpose.

Compliance with Laws: You agree to use the Services in compliance with all applicable local, national, and international laws and regulations.

We collect and process the following categories of personal data:

Personal Information:

• Full name and email address provided at registration

• Language preferences and account settings

Assessment Data:

• Your responses to vocational assessment questions

• Aptitude scores and computed career recommendations

• Assessment timestamps and completion history

Behavioral & Usage Data:

• Pages visited and features used within the application

• Device type, browser type, and operating system

• Session duration and interaction patterns

• Error logs and performance data

How We Use Your Data:

• Service Delivery: To generate your personalized vocational profile, career recommendations, and downloadable reports.

• Personalization: To tailor the experience to your language, history, and preferences.

• Algorithm Improvement: To refine and improve the accuracy of our AI models using aggregate, de-identified data.

• Analytics: To understand usage patterns and improve platform performance and design.

• Communications: To send service-related notifications, updates to this Agreement, and (where consented) promotional information.

Anonymized & Aggregated Data: We may use anonymized, de-identified, or aggregated data — from which you cannot be personally identified — for research, benchmarking, product improvement, and statistical reporting without restriction.

We do not sell your personal information to third parties.

We may share your data only in the following limited circumstances:

Service Providers: We work with trusted third-party technology providers (such as cloud hosting, payment processors, email delivery, and analytics platforms) who process data on our behalf and are contractually bound to protect it in accordance with this Agreement.

Educational Institutions: If you explicitly choose to share your report with an institution using our sharing features, that institution may receive the specific data you authorize. We will never automatically share your data with educational partners without your direct action.

AI & Analytics Providers: Our AI models may be processed by third-party infrastructure providers. All such processing is governed by data processing agreements that prohibit use of your data for any purpose other than service delivery to VocaPath.

Legal Requirements: We may disclose your information if required to do so by law, court order, or governmental authority, or if we believe disclosure is necessary to protect our rights, the safety of users, or to prevent fraud.

Business Transfers: In the event of a merger, acquisition, or sale of all or substantially all of our assets, your data may be transferred to the successor entity, subject to equivalent privacy protections.

We will not share your personally identifiable information for third-party marketing purposes without your explicit, separate consent.

VocaPath uses artificial intelligence and statistical algorithms to generate career and aptitude recommendations. You should be aware of the following important limitations:

Algorithmic Nature: All recommendations are produced by automated systems based on patterns learned from data. They are not the product of individualized professional assessment by a licensed counselor, psychologist, or career advisor.

Potential Inaccuracies: AI-generated outputs may not fully reflect your individual circumstances, experiences, values, cultural context, or life goals. Recommendations may be incorrect, incomplete, or not applicable to your specific situation.

No Professional Substitute: VocaPath's outputs are not a substitute for professional career counseling, psychological evaluation, academic advising, or medical advice. We strongly encourage you to consult with qualified professionals before making significant life decisions.

No Guarantee of Outcomes: A career appearing in your results does not guarantee suitability, admission, success, or employability in that field. Career outcomes depend on many factors outside the scope of any assessment tool.

Continuous Improvement: We continually work to improve the accuracy of our AI, but no algorithm is perfect. Results should be treated as one useful input among many in your decision-making process.

To the fullest extent permitted by applicable law:

No Liability for Decisions: VocaPath shall not be liable for any decisions you make based on or in reliance on the information, recommendations, or analysis provided through the Services. You assume full responsibility for all decisions made following your use of the platform.

No Guarantee of Outcomes: VocaPath makes no representations or warranties that use of the Services will lead to any particular educational, career, professional, or financial outcome.

Limitation of Damages: In no event shall VocaPath, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of the Services, even if advised of the possibility of such damages.

Cap on Liability: To the extent permitted by law, VocaPath's total aggregate liability to you for any claims arising from this Agreement or the Services shall not exceed the greater of (a) the total amount you paid to VocaPath in the twelve (12) months preceding the claim, or (b) fifty United States dollars (USD $50.00).

Disclaimer of Warranties: The Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

By accepting this Agreement (via the checkbox at sign-up or login), you explicitly confirm and acknowledge the following:

Data Processing Consent: You understand and consent to the collection, storage, and processing of your personal data as described in Section 4 (Data Collection & Use) and Section 5 (Data Sharing & Third Parties) of this Agreement.

Understanding of Service Limitations: You understand that VocaPath provides informational tools only and that results and recommendations are not guaranteed to be accurate, complete, or applicable to your individual circumstances.

Limitation of AI Recommendations: You acknowledge that career and aptitude recommendations are generated by AI algorithms and are not a substitute for qualified professional guidance.

Voluntary Use: You confirm that your use of the Services is voluntary and that you are not being compelled by any third party to use or act upon the results.

Legal Capacity: You confirm that you are of legal age in your jurisdiction to enter into this Agreement, or that you have obtained the requisite parental or guardian consent if you are a minor.

This consent may be withdrawn at any time by contacting us at legal@vocapath.ai. Withdrawal of consent may result in the termination of your ability to use the Services.

We take the protection of your personal data seriously and implement industry-standard technical and organizational measures to safeguard it, including:

• Encryption in Transit: All data transmitted between your device and our servers is encrypted using TLS (Transport Layer Security) protocols.

• Encryption at Rest: Sensitive data stored in our systems is encrypted using industry-standard encryption algorithms.

• Access Controls: Access to personal data is restricted to authorized personnel on a strict need-to-know basis. All access is logged and monitored.

• Secure Authentication: User accounts are protected through secure authentication mechanisms.

• Third-Party Security: We require all third-party service providers who handle user data to maintain equivalent or higher security standards through contractual data processing agreements.

• Incident Response: We maintain a security incident response plan and will notify affected users and relevant authorities in the event of a data breach as required by applicable law.

Despite our best efforts, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security but are committed to protecting your information to the best of our ability.

Depending on your jurisdiction, you may have the following rights regarding your personal data:

Right of Access: You may request a copy of the personal data we hold about you, including your assessment responses and recommendations.

Right to Correction: You may request that we correct inaccurate or incomplete personal data about you.

Right to Deletion ("Right to Be Forgotten"): You may request the deletion of your personal data from our systems, subject to any legal obligations we may have to retain certain records.

Right to Data Portability: Where technically feasible, you may request that your data be provided to you in a structured, machine-readable format.

Right to Restrict Processing: You may request that we limit the processing of your data in certain circumstances.

Right to Object: You may object to the processing of your data for direct marketing purposes or based on our legitimate interests.

Opt-Out of Non-Essential Communications: You may opt out of promotional or marketing emails at any time by clicking "Unsubscribe" in any such email or by contacting us.

Minimum Age Requirement: VocaPath's Services are intended for users who are at least 13 years of age in jurisdictions governed by U.S. law (COPPA), and at least 16 years of age in jurisdictions governed by the European General Data Protection Regulation (GDPR) or equivalent legislation.

Children Under 13: We do not knowingly collect personal information from children under 13 years of age. If we become aware that a child under 13 has provided us with personal data without parental consent, we will take steps to delete that information promptly.

Users Ages 13–17 (Minors): If you are between the ages of 13 and 17 (or the applicable age of majority in your jurisdiction), you must have obtained explicit consent from a parent or legal guardian before using the Services. By using VocaPath, you represent that you have obtained such consent.

Parental Rights: Parents or legal guardians of minor users may contact us at legal@vocapath.ai to request access to, correction of, or deletion of their child's data.

If you believe a minor has registered on our platform without proper parental consent, please contact us immediately.

We may update, modify, or revise this Agreement from time to time to reflect changes in our Services, legal requirements, or business practices.

Notification of Changes: When we make material changes to this Agreement, we will notify you through one or more of the following methods:

• A prominent notice displayed within the application

• An email notification sent to the address associated with your account

• An updated "Last Updated" date displayed at the top of this Agreement

Acceptance of Revised Terms: Your continued use of the Services after the effective date of any revisions constitutes your acceptance of the updated Agreement. If you do not agree to the revised terms, you must discontinue your use of the Services.

We encourage you to review this Agreement periodically. The most current version will always be accessible within the application and on our website.

This Agreement and any dispute, claim, or controversy arising out of or relating to it or your use of the Services shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles.

Jurisdiction: You agree to submit to the exclusive jurisdiction of the courts located in the State of New York, United States for the resolution of any disputes not resolved through the process described below.

Informal Resolution: Before initiating any formal legal proceedings, the parties agree to attempt to resolve any dispute informally by contacting us at legal@vocapath.ai. We will use good-faith efforts to resolve the matter within 30 days of receiving written notice.

Arbitration: To the extent permitted by law, any disputes that cannot be resolved informally may be subject to binding arbitration under the rules of the American Arbitration Association (AAA), with proceedings conducted in English in New York, NY.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis only, and you waive any right to participate in a class action, class arbitration, or representative proceeding.
